Treason case: Court issues notices to defense counsels

ISLAMABAD: Special Court (SC) has adjourned the hearing of treason case against former president Pervez Musharraf till today on the request of defence lawyers.

The court has also issued notices to counsel for former president on the applications filed by prosecutor Akram Sheikh raising objections on detailed medical report and seeking summoning of head of AFIC.

A 3-member bench of SC led by Justice Faisal Arab took up high treason case for hearing Wednesday.

Defence counsel Anwar Mansoor appeared before the court and took the plea the entire team of defence counsels is pre-occupied in Supreme Court in connection with review petition against July, 31, 2009 apex court decision. He requested SC to adjourn the hearing of the case due to engagement of defence counsels team in review petition.

Justice Faisal Arab inquired from defence counsel if the Supreme Court has issued any stay order with reference to high treason case on the basis of which the hearing of this case should be adjourned.

Anwar Mansoor told the court that Supreme Court has issued no stay order. However we request that hearing of the case be adjourned.

Justice Faisal Arab remarked " how can the hearing of the case be adjourned if Supreme Court has issued no stay order.

Anwar Mansoor requested the court that the entire defence team is unable to pursue high treason case in special court being engaged in Supreme Court therefore, the hearing of the case be put off.

Prosecutor Akram Sheikh told the court he had filed two applications with registrar of special court with reference to objections raised by him on detailed medical report of former president and summoning head of AFIC in the court. These applications may please be considered as well, he prayed.

Justice Faisal Arab while addressing defence counsel remarked the defence counsels will have to file application in this court on exemption of the accused from attendance as the adjournment of the case and exemption from attendance are two different matters.

The defence counsel said medical report has been filed in the court through which the court has been informed about the details of the health of the accused and application for exemption has already been filed in the court.

The hearing of the case has been adjourned till today.
