ISLAMABAD: The local court of Islamabad on Monday deferred its decision on a bail application filed by Lal Masjid cleric Maulana Abdul Aziz as his counsel informed the court that due to deployment of security personnel outside his residence the cleric could not appear before the court.

Maulana Aziz moved the pre arrest bail application before the additional district and sessions judge of Islamabad in two separate cases – extending threats to the civil society and inciting sectarian hatred. The cases were registered against him in October 2014.

His lawyer advocate Tariq Asad argued before the court that the cleric could not personally appear before the court as he is under the ‘siege’ of law enforcement agencies.

Advocate Asad also moved before the court an application seeking the cleric’s exemption from personal appearance in the court. He contended that though the presence of the accused before the court was mandatory to obtain bail but since the cleric is under the ‘seige’ of the law enforcement agencies, he was unable to appear personally.

He expressed apprehensions that the cleric may be arrested if he comes out of his residence.

The counsel, however, suggested to the court to pass an order regarding production of the cleric so the police official could produce him on Tuesday.

Subsequently, the additional district and sessions judge directed the Aabpara SHO to facilitate appearance of the cleric before the court on Tuesday.
