Fuel surcharge up to 350 units is illegal: LHC

The Lahore High Court has declared the fuel charge on the use of up to 350 units of electricity, during the hearing of over 80 petitions against the fuel adjustment surcharge by Justice Khalid Mahmood Khan.

The Lahore High Court has declared the fuel charge on the use of up to 350 units of electricity, during the hearing of over 80 petitions against the fuel adjustment surcharge by Justice Khalid Mahmood Khan.

Lawyers of the petitioners told the court that according to the law NEPRA could not levy fuel adjustment surcharge in electricity bills. The fuel adjustment surcharge is being levied illegally, the lawyers argued.

NEPRA has submitted the reply in the court that fuel adjustment surcharge is not a tax but is rather the power cost of power which is being collected from the consumers.

The court declared the imposition of fuel adjustment surcharge up to  350 units of power after the completion of arguments by the arguments of both the sides. The court sent the matter pertaining to consumers utilizing over 350 units of power to NEPRA so that a decision about it could be made within a month.
